On July 31, 2024 at 10:00 AM, the Senate Committee on Energy and Natural Resources held a business meeting to consider S.4753, also known as the “Energy Permitting Reform Act of 2024.” This bill was drafted jointly by the leaders of the Senate Energy and Natural Resources Committee, Senators Manchin (I-WV) and Barrasso (R-WY), and proposes reforms to leasing, permitting, and judicial review for certain energy and mineral projects.
Senator Manchin opened the mark-up by discussing how this bill needs support from both Republicans and Democrats because bipartisan laws can weather the test of time. The sponsors believe the bill strikes a balance between the goals of encouraging clean energy development and ensuring reliable and stable power. Senator Manchin expressed urgency in limiting the amendments so that the Senate has sufficient time to consider the legislation prior to the upcoming election.
The bill is intended to increase onshore and offshore oil, gas, and wind production, expedite the construction of electric transmission facilities, limit judicial review, expedite permitting, and expedite liquefied natural gas (“LNG”) exports. Senator Murkowski (R-AK) expressed disappointment that this bill does not sufficiently consider hydropower development. Senator Manchin provided assurance that it would be addressed.
The bill received overwhelming and bipartisan support, passing with a 15-4 vote in the Committee. The bill will move to the Senate floor for consideration where timing is uncertain and House action is not yet scheduled.
