DWGP Attorneys Present at APPA Academy on New PURPA “Shall Consider” Provisions

On June 28, 2022 at 2:00 P.M. EST, DWGP attorneys Sean Neal and Lauren Perkins presented a webinar as part of the American Public Power Association (“APPA”) Academy offerings on new “Shall Consider” provisions added to the Public Utility Regulatory Policies Act of 1978 (“PURPA”).  State commissions and “nonregulated electric utilities” are required by Title I of PURPA to consider certain federal electricity policy standards within specified time windows and make a determination as to whether it is appropriate to implement them.  Last year’s Infrastructure Investment and Jobs Act (“IIJA”) amended PURPA to add two new “shall consider” standards, concerning, (1) demand response and demand flexibility; and (2) electric vehicle charging programs.  The webinar is designed to provide useful context and insights to public power utilities in satisfying the “shall consider” requirements.  Please see APPA’s website for further information.
