On October 19, 2021, Peter Scanlon and Sylwia Dakowicz presented on the legal implications of distributed energy resources at the American Public Power Association (APPA) Legal & Regulatory Conference held in Savannah, Georgia on October 17-20, 2021. Their presentation addressed the rapid increase in distributed generation and the resulting system of net-metering, renewable energy credit programs, and standby charges. They also discussed the application and legal challenges presented by the Public Utility Regulatory Policies Act of 1978 (PURPA), which indicates that distributed generation be compensated at “avoided cost” for the energy provided to the grid, that such customers not be charged an unreasonable or discriminatory rate when they require service from the grid, and that utilities must provide backup power.
