Kristen Connolly McCullough was the invited speaker to the July 14, 2020 meeting of the National Association of State Utility Consumer Advocates (NASUCA) Electricity Committee.  During this meeting, Ms. Connolly McCullough presented on FERC and State Return on Equity (ROE) Policy Updates.  She provided a general overview of current state ROE results and capital market conditions, including the current effects of the COVID-19 global pandemic.  In addition, she focused on the recent shift in ROE policy by FERC, culminating in Opinion No. 569-A, which impacts ROE results and ratepayers’ and consumer advocates’ ability to challenge existing ROEs through complaints filed pursuant to section 206 of the Federal Power Act due to newly established presumptive just and reasonable ranges of ROEs.  NASUCA is an association of 55 consumer advocates in 43 states and the District of Columbia, Barbados, Puerto Rico, and Jamaica, whose members are designated by the laws of their respective jurisdictions to represent the interests of utility consumers before state and federal regulators and in the courts.  Ms. Connolly McCullough is a Shareholder at DWGP and serves as outside counsel to the Office of People’s Counsel for the District of Columbia on two ongoing rate proceedings before the Public Service Commission of the District of Columbia.  For further information, please contact This email address is being protected from spambots.
